2Gen NBN Fair Usage Policy

Purpose of this Policy

This Fair Use Policy is designed to ensure that all our customers have a positive experience and that our network operates fairly for everyone. It applies to all our internet plans, especially those with “unlimited” data. This policy outlines what we consider to be unacceptable use of our service.

What is Unacceptable Use?

Your use of our service is unacceptable if you use it in a way that is:

  • Illegal: Engaging in any activity that breaches any law, such as infringing copyright by downloading or sharing pirated material.
  • Commercial: Using a residential plan for commercial purposes, such as running a business, web hosting, or operating a server that generates significant traffic.
  • Harmful to the Network: Compromising the security or integrity of our network or the NBN. This includes hacking, sending viruses or malware, or launching denial-of-service attacks.
  • Excessive or Unreasonable: Using the service in a manner that is far beyond typical residential use, which negatively impacts the network and the service quality for other customers.

Examples include:

  • Automated or continuous high-volume file transfers.
  • Using the service as a substitute for a dedicated business-grade connection.
  • Reselling: Sharing, reselling, or providing your service to others outside of your premise.
  • Spamming: Sending unsolicited bulk emails or messages.

How We Manage Unacceptable Use

We monitor our network for traffic patterns that indicate a potential breach of this policy. If we detect usage that we consider to be unacceptable, we will take the following steps in order:

1. Contact and Warning: We will contact you to discuss your usage and explain why it may be in breach of this policy. We will ask you to modify your usage to bring it in line with what is considered fair and reasonable for a residential service.

2. Service Modification (Shaping): If the unacceptable use continues, we reserve the right to slow down (“shape”) your connection speed or de-prioritise your traffic during busy periods to protect the experience of other customers. We will provide you with notice before this occurs.

3. Suspension or Termination: For serious or repeated breaches, we may suspend or terminate your service, as outlined in our Standard Form of Agreement. We will only take this step after we have attempted to contact you to resolve the issue.

Changes to this Policy
